Liability Waiver

PADDOCK SIMWORKS — PARTICIPANT ASSUMPTION OF RISK AND LIABILITY WAIVER

1. Activity Description

I wish to participate in racing simulator activities provided by Paddock SimWorks (“the Company”) at an event in the Long Island, NY area and surrounding areas. The activity involves the use of professional racing simulator equipment including direct-drive wheelbases, force feedback pedals, and large curved display monitors.

2. Assumption of Risk

I understand that participation in simulator activities involves certain inherent risks, including but not limited to: motion sickness, dizziness, nausea, disorientation, eye strain, physical discomfort from seated position, and potential for emotional distress due to the immersive nature of the simulation. I voluntarily assume all such risks.

3. Health Advisory

I confirm that I do not have any medical conditions that would prevent or restrict my participation, including but not limited to: epilepsy, photosensitive seizures, severe motion sickness, vertigo, recent surgery or injury, heart conditions, or any other condition contraindicated by immersive visual simulation. I accept full responsibility for determining my own fitness to participate.

4. Release of Liability

In consideration of being permitted to participate, I, for myself and on behalf of my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless Paddock SimWorks, its owners, operators, employees, agents, partners, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me during or as a result of my participation.

5. Rules of Conduct

I agree to follow all instructions provided by Paddock SimWorks staff. I understand that no food or beverages are permitted at or near the simulator stations. I agree not to engage in reckless or disruptive behavior that could damage the equipment or endanger other participants.

6. Age Requirement

I confirm that I am at least 13 years of age, or that I am the parent/legal guardian of a minor participant (age 13 or older) and am signing on their behalf.

7. Photography & Media

I grant Paddock SimWorks permission to photograph and/or video record my participation for promotional and marketing purposes.

8. Governing Law

This agreement shall be governed by the laws of the State of New York.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT IN FULL, THAT I UNDERSTAND ITS TERMS, AND THAT I AM VOLUNTARILY SIGNING IT.
